SALES TO END USERS ONLY
The Kobo Service sells Products to end user customers only.
Except for magazine subscriptions (detailed below) all sales are final. The Kobo Service commences immediately when you begin to download content from the Kobo Service and you will not have a right to cancel your contract once the service commences.
The Kobo Service accepts credit cards. When a credit is being used for a purchase, Kobo may obtain a pre-approval from the credit card company for an amount up to the amount of the order. Billing to your credit occurs at the time of purchase, or shortly thereafter.
The Kobo Service accepts the following payment cards: Visa and MasterCard.
Depending on the country in which you are making your purchase, the following payment methods may also be available: American Express, Visa Debit, PayPal, iDeal and JCB.
- Credit cards have daily spending limits that may prevent the processing of your order.
- If a transaction has been declined online due to credit issues, please ensure all data is correct and resubmit. If the transaction is not accepted online, you will be unable to use that card for your transaction and should use another payment card.
If you are purchasing multiple items on the Kobo Service, your order may be authorised and billed in gradual increments during one purchasing session as you click the Buy button. This may appear as multiple orders and billings on your payment card statement.
If you purchase a subscription that includes a free trial, you will receive free access to the content for the duration of the free trial period. At the end of your free trial period, Kobo will charge or debit the payment method provided at the time of your order, and you will be billed according to the cycle stated at the time of your order. If you do not want to keep the subscription following the free trial and do not want to incur any charges, to avoid having your payment method charged you must cancel the subscription as provided in these terms prior to the end of your trial period.
Your payment details must be verified before your subscription can be activated, including any free trial. If your initial payment authorization is later revoked, your subscription will be terminated. Please contact Customer Care if you believe your access was terminated in error. You must also notify Customer Care promptly of any change in your name, billing address, e-mail address, telephone number or payment method information.
Kobo will charge or debit your payment method at the beginning of your subscription for the full amount of the subscription, plus any applicable taxes. You will be sent a confirmation receipt. Following the initial payment, unless you otherwise cancel your subscription, you will be charged annually on the anniversary date using the payment method we have on file.
ALL SUBSCRIPTIONS WILL, UNLESS WE RECEIVE NOTICE FROM YOU TO THE CONTRARY, RENEW AUTOMATICALLY AT THEIR EXPIRY FOR A ONE YEAR TERM AT THEN CURRENT RATES. If at any point you do not wish to have your subscription automatically renewed, you may cancel it without penalty before the end of the subscription term. You will be notified 30 days in advance of any impending subscription renewals.
For each subscription renewal, Kobo will charge or debit the payment method you originally used to make the purchase. If your credit card expires or your payment method is otherwise invalid, Kobo reserves the right to immediately terminate and/or fail to renew your subscription. Kobo will notify you that the payment method failed, and allow you to update or change your payment method and either permit you to keep your subscription running or require you to start a new subscription.
CANCELLATIONS AND REFUNDS
You may cancel your subscription at any time, and you will receive a prorated refund based on the number of issues not yet received in your subscription period. Following Kobo’s provision of a refund to you, you will no longer have the right to access any issues of the relevant subscription not yet received.
We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.
If a magazine is no longer available on Kobo (for example, if a title is no longer being made available by the publisher), Kobo will give you a refund, which may be a full refund for the current period of the subscription or a partial refund for issues not yet received in your subscription period.

The latest version of the Kobo Client software is recommended to access the Kobo Service. From time to time, an upgrade to the latest version of the Kobo Client software may be required in order to make transactions from the Kobo Service. Use of Kobo Client software is subject to acceptance of its software license agreement presented at the time of installation.
Kobo reserves the right to enhance Products purchased from the Kobo Service. Among other things, such enhancements may result in larger file sizes (requiring, for example, longer download times and additional disk space for storage).
The Kobo Service endeavors to offer you competitive prices on current selections. Your total price will include the price of the Product. For Canadian customers only the price will also include additional applicable sales taxes, including GST/HST, QST and/or provincial retail sales tax (in effect on the day of purchase). For UK customers only, prices are inclusive of VAT when applicable. Kobo reserves the right to change prices for Products offered at the Kobo Service at any time, and does not provide price protection or refunds in the event of a price drop or promotional offering.
The Kobo Service makes every effort to provide a broad content offering. For this reason, Kobo reserves the right to change content options without notice. On occasion, a Product may become unavailable following a transaction but prior to download. Your sole remedy in such cases is a refund of the price paid for the unavailable Product. Please contact Kobo Customer Service for assistance in such cases (see below).

CONTENT USAGE RULES
Your use of any Products purchased from the Kobo Service is conditioned upon your prior acceptance of the Terms of Service, including, without limitation the Usage Rules, set forth therein.
OTHER TERMS AND CONDITIONS
Kobo reserves the right to change the terms and conditions of sale at the Kobo Service at any time. Revised Terms of Sale will be made available on our website. Customers are encouraged to review the Terms of Sale on a periodic basis for modifications.
All sales on the Kobo Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein without regard to conflict of laws rules.
If any of the terms in these Terms of Sale are not valid or legally enforceable, the other terms will not be affected.
